Terms of Sales

General terms of on-line sale

The following terms of sale are concluded between on the one hand, the firm Fontaines Pétrifiantes, a limited liability company with a capital of 35 000€ registered on the Register of Commerce of Issoire under the number 332264704, whose registered office is situated in Saint-Nectaire (F-63710), and on the other hand any legal entity or individual desirous of making a purchase in the on-line shop of that firm Fontaines Pétrifiantes de Saint-Nectaire.

Those terms aim at defining the contractual relationships between the firm Fontaines Pétrifiantes and the purchaser, whether he is a professional or a consumer. The purchase of a work of art by means of that website implies from the buyer total acceptance of the present terms of sale. Those terms will prevail over any other general or specific terms which the firm Fontaines Pétrifiantes de Saint-Nectaire would not have expressely authorized.

The firm reserve the right to modify their terms of sale at any time: then the applicable terms are those in force at the date the buyer puts in his order.

First article: typical features of the offered goods and services

The works of art put for sale are those published in the on-line shop of the Internet website www.fontaines-petrifiantes.en within the limits of the available supply.

The photographs of the offered works are not contractual. The firm Fontaines Pétrifiantes de Saint-Nectaire are in no way liable slightly different colors or dimensions.

Second article: Modes of order

– Please refer to the catalogue, make your selection of products and add them to the basket,
– Fill in the identification form on which you will mention all the required details (addresses for delivery and invoicing),
– Validate your order after having checked it,
– Make your payment on the fixed conditions
– Confirm your order and payment

The confirmation of his order means the buyer’s acceptation of the present terms of sale and thus the renouncement of his own terms of purchase or any other conditions. The whole given data and the recorded confirmation will produce evidence of the transaction. The confirmation will equal both his signature and acceptation of the effected deals.

The firm Fontaines Pétrifiantes de Saint-Nectaire will send back by e-mail the confirmation of the order and will keep the customer informed within the shortest delay of the possible unavailability of the ordered items.

Third article: Sale prices

The prices listed in the catalogue are inclusive of tax, in euro, any change in the VAT rate is likely to be passed on to the sale prices of the works of art. The firm Fontaines Pétrifiantes reserve the right to modify their prices at any time, but the prices listed on the catalogue on the day of the order remain the only ones applicable to the customer. The packing, forwarding and insurance charges will be paid by the customer and invoiced as a supplement on the sale price, according to the current postal rates.

Fourth article: Modes of payment

The price is payable with order you will pay by credit Card with Stripe. The account gets debited as the order gets confirmed. Payments by credit card are guaranteed by a Stripe-secured system which ensures the security and confidentiality of the data transmitted while paying.  The firm Fontaines Pétrifiantes de Saint-Nectaire does not retain customers’ bank data.

The order will only be dealt with after reception of the payment onto the firm Fontaines Pétrifiantes de Saint-Nectaire’s bank account.

If any problem occurs while ordering or paying, the customer can contact the firm Fontaines Pétrifiantes on the same number: 33 (0)4 73 88 50 80.

An invoice printed on paper mentioning VAT will be enclosed with the parcel.

Fifth article: Delivery

5.1 Modes of delivery

Delivery is operated by the French Mail Service (La Poste) or some private haulage contractor depending on the geographic area. The current rates are those applied by the haulier. The packing, insurance and forwarding charges are not included in the price of the work of art. Those charges will be applied at the time of the order. The delivery will be made at the address mentioned on the order form. In the absence of the customer at the time of the delivery, a notice will be dropped into his letter-box. The delivery of the ordered item will be made in exchange for the customer’s signature. In case of wrong address, the charges for forwarding the parcel to the correct address will be paid by the customer.

5.2 Delivery cost

It depends on the place of delivery, on the total weight and on the value of the parcel. The firm fix prices according to geographic areas. They include insurance, packing, forwarding charges in accordance with the current postal rates. The customer may obtain more details on those charges by e-mail: contact@fontaines-pétrifiantes.fr or by phone on 33 (0)4 73 88 50 80.

These delivery charges may be modified at anytime by the haulier. Those modifications will be passed on to the sale price. Please note that all our consignments are covered by insurance. If on delivery, the goods are damaged or missing, or if the original packaging has been opened and/or damaged, the customer will have to reject the goods and write his reservations on the delivery slip (rejected parcel because it was opened or damaged). The customer will have to let the firm Fontaines Pétrifiantes de Saint-Nectaire know about it as soon as possible by any suitable means.

5.3 Delivery periods

Except for reasons of the greatest importance (total or partial strike of French mail services, fire major disruptions or flooding), the delivery periods are given for information. Normal delivery period with the Colissimo mail Services : from 3 to 8 working days, depending to the country of the destination. The Firm Fontaines Pétrifiantes de Saint-Nectaire will not be considered liable for the non-fulfilment of the present contract.

If the delivery period is not respected, the customer has to let the firm Fontaines Pétrifiantes de Saint-Nectaire know about it by any suitable means. If during the inquiry (21 days), the product is found, it will be automatically re-forwarded to the mentioned address. Otherwise the firm Fontaines Pétrifiantes de Saint-Nectaire, undertake to send a substitute product to the customer at their own expense, if it is available, or to pay back the total amount of the product lost by the haulier.

Sixth Article : Withdrawal

Customers have a period for withdrawal of 14 days starting on the date of delivery of their order to return their product to the firm Fontaines Pétrifiantes de Saint-Nectaire for exchange or repayment without extra-charges but for re-forwarding costs and provided that the returned item is in perfect condition. The mentioned period starts on delivery of the goods. If the 14-day period expires on a Saturday, Sunday, bank holiday or public holiday, it will be extended to the first following working day. The buyer has to return the goods as they are and with some packaging equivalent to that of forwarding within a period of 15 working days at the most. In the event of loss of the original packaging, the buyer has to contact the firm Fontaines Pétrifiantes de Saint-Nectaire to get informed of the modes of packaging of the product. The buyer has to arrange a suitable and safe packaging. That re-forwarding must include a transport insurance covering the possible loss or damage of the parcel.

If that withdrawal right is correctly exercised in the above defined terms, the firm Fontaines Pétrifiantes de Saint-Nectaire undertake to reimburse the purchase in the 14 working days following the date of agreement.

Seventh Article – Disputes

The present contract is subject to French Law. The Firm Fontaines Pétrifiantes de Saint-Nectaire are not liable for any possible damage resulting from some wrong use of the marketed works of art.

If the customer has difficulty in putting the present contract into practice, he can try and find an amicable arrangement with the firm Fontaines Pétrifiantes, otherwise the liability would be incumbent to the French courts of competent jurisdiction, despite plurality of defenders or appeal to implement guarantee.

General sales conditions / Visiting service

First article: Opening time

The visiting site is opened to the public all year round as mentioned on its advertising documents and on its website www.fontaines-petrifiantes.fr. The management cannot be accountable for any wrong information published in other media. The management reserves the right to modify the range of opening hours at any time.

Second article: Fees

Entrance fees must be paid for before the visit starts, except for previous agreement (refer to 6th article).
Reduced fees are granted to group and disabled people, on presentation of a written proof. Customers interrupting the visit on their own initiative will not be paid back.

Third article: Main features pf the offered

Visitors have autonomes or guided access to the successive steps of the visit. However, in case of pressing circumstances inherent in the site running, of security or technical problems, the visit is likely to be modified and customers will not be able to lay claim to an compensation, as the alternative tour does not impede the understanding of the initial visit content. In summertime compulsory guided visits are organized.

Fourth article: Guided visits for groups

Guided visits are organized on the site opening days, except for special agreement, for groups made of at least 25 adults or school children having booked in advance. Any group, who turn up without previous booking will be guided only if a guide is available. A group may not exceed 55 people. A greater number would make up a second group.

Fifth article: Group fees

Reduced entrance fees are granted to groups of more than 25 people on precise booking conditions. Free admission their guide and the couch driver. Group of school children: one accompanying adult for 10 children gets free admission.

Sixth article: Booking and payment conditions

Booking a guided visit may be made by phone, mail or email. The management will send an acknowledgement receipt of the booking. That booking takes effect 3 weeks before the visiting day and consequently the reduced fees in force will be applied. The booking defines the arrival time of the group, the number of people and the payment moves. Except for previous agreement, the booking is definitively confirmed only at reception of a 50% down payment of the total sum payable by credit card / online or by cheque made out to Fontaines Pétrifiantes de Saint-Nectaire. The balance is due for payment on the visiting day.

In previous accordance with the organizing travel agent, the payment can be made on invoice: a voucher or an order form will be required. The payment is due bill reception. Bills the total of which does not reach 60€ will be increased of an additional tax of 3,33€ tax free that is 4€ inclusive of tax.

Seventh article: Interruption of the visiting service – Cancellation

Within the scope of a booked visit, customers should warn the management of any delay behind schedule. Any delay may affect the initial duration of the visit and customers will not possibly claim for being reimbursed.

In case customers should cancel a booked visit, the following conditions will be applied:
– Cancellation occurring between 30 and 15 days before the booked date: another appointment may be arranged according to the availability of the 2 parties, without further charges for the customers. If no agreement is made, 10% of the visit fee will be deducted from the down payment.
– Cancellation occurring less than 14 days before the visit: another date may be arranged between the 2 parties according to availability, without expense on the customers’ part. Without new booking, the down payment will not be reimbursed.
– If customers do not turn up, they will not lay claim to any reimbursing.
– In case of payment on invoice, without prior down payment, the total amount of the service will be due if the visits gets cancelled 14 days before the booked date and an invoice will be established unless an other date may be arranged between the 2 parties according to availability, without expense on the customers’ part.

Weather conditions or transport strike are not considered as reasons for cancellation and do not give way to repayment. In case of cancellation on the management’s part, for any other reason than absolute necessity, customers not prejudging any appeal  for compensation of the suffered loss, may either obtain the reimbursing of the down payment without penalty or accept the booking modification.

Eight article: Responsabilities

For security and responsibility reasons, the management reserves the right to refuse admittance to the visiting site to anyone whose behavior is obviously incompatible with the level of attention required during the visit. Customers are responsible for any damage occurring by their faults. They should take out a civil liability insurance policy to cover the possible risks. They commit themselves to respect the use regulations on the visiting site.

The management has subscribed a professional civil liability policy n°AP235681 at Générali, Agent Baubet-Boudon, 4 Bd de la Ss préfecture, 63501 Issoire cédex.

Ninth article: Disputes – Acceptation of the general sales conditions

Any complaint related to the visit should be addressed within the 3 days following the visit by mail or phone and the management will try and find an amicable arrangement. Purchasing an entrance ticket for a guided or non-guided visit implies full acceptation of those general sales conditions.

The present GSC are submitted to French law. Any dispute relative to the application of those GSC comes exclusively within the court of Issoire.
